Ex-HR Director Faces Retaliation for Filing Discrimination Complaint: EEOC

A former Georgia county human resources director is expected to get $112,000 from the county for facing retaliation after she submitted internal discrimination complaints. So reports the Henry Herald.

The Equal Employment Opportunity Commission (EEOC) proposed a conciliation agreement that would include the county paying Nedra Swift $87,000 in back pay and $25,000 for non-pecuniary compensatory damages. Swift had served as the HR director for Henry County. 

The agreement also requires the county to provide training for its management staff pertaining to Title VII of the Civil Rights Act and the Age Discrimination in Employment Act. The county fired Swift in December 2015. In her complaint, Swift, 60, alleges that the county subjected her to a harsh work place environment due to her race, age and sex.

The EEOC did not find evidence to support those claims, but did find that the county retaliated against Smith because she filed two internal complaints to county officials in 2015.

“The evidence does reveal…[that Swift] filed two separate internal complaints of discrimination with the Respondent and that the respondent failed to take swift, remedial action into the complaints,” the EEOC found.

Swift said she filed an internal complaint October 2015 and Dec. 7, 2015, alleging racial discrimination and retaliation. She was fired Dec. 8, 2015. The county told the EEOC that it fired Swift because she did not effectively do her job and did not want to be supervised.
